The IRS and the Attorney General of Finance published, on Tuesday (18) in the Official Gazette of the Union, joint decree establishing the creation of groups that will act to combat fraud, the administrative collection and tax execution ( Gaefis).
According to the ordinance, the goal is to "identify, prevent and prosecute tax fraud which endanger the recovery of tax credits or registered in Active Debt of the Union."
Teams will be indicated by the regional offices of the Internal Revenue Service and the general prosecutors from the National Treasury, which will make the appointment within 90 days.
According to the text, it is the Gaefis in relation to selected cases, take into consideration "the harmful potential of fraud; the risk of inefficiency of collection or tax enforcement; and the need to take urgent legal measures to ensure the effectiveness of the collection. "
The Gaefis members will meet at least monthly and, among other measures, must apply for the balance monitoring of taxpayers or third parties involved in the commission of fraud the charging or tax enforcement to propose legal measures and recovery tax credits.
Also, they may propose search and seizure actions, data breach of confidentiality or other measures necessary for the production of evidence for demonstration tax liability or location of assets and rights on behalf of the taxpayer or a third party involved in tax fraud.
